MASTER TERMS, CONDITIONS & DISCLAIMERS

These Master Terms, Conditions, & Disclaimers govern your use of the services, deliverables, and website operated by Fearless Media LLC. By hiring us, accessing our website, or communicating with us, you agree to these Terms.

1. Scope of Services

Fearless Media (“the Company”) provides photography, videography, social media management, advertising, website design, branding, and marketing services (collectively, “Services”) as outlined in each project’s Scope of Work or Contract. Each Service will be delivered according to the agreed project outline, deliverables, and timeline described in the client’s individual agreement.

2. Booking & Payment

  • A signed agreement and initial deposit are required to reserve project dates.

  • Deposits are non-refundable.

  • Remaining balances are due on or before the scheduled filming or service date, unless otherwise stated in writing.

  • Projects will not enter production, editing, or delivery until payment requirements are met.

  • All invoices are subject to applicable sales tax as required by Pennsylvania state law.

3. Cancellations, Rescheduling & Delays

  • If a client cancels or reschedules a project less than 7 days before the scheduled date, the deposit is forfeited.

  • Fearless Media will make reasonable efforts to accommodate rescheduling due to weather, illness, or unforeseen circumstances.

  • If Fearless Media must reschedule due to emergency or illness, the client will be notified promptly and the project will be rescheduled at no additional cost.

  • Extended delays by the client in providing assets, approvals, or content may result in timeline adjustments or additional fees.

4. Revisions & Edits

  • Each project includes a set number of revisions as specified in the individual Scope of Work.

  • Additional revisions or major changes beyond the agreed scope may incur extra costs.

  • Once the final deliverables are approved, any subsequent edits or adjustments will be billed separately.

5. Deliverables & Turnaround

  • Typical delivery time varies based on project type and is outlined in each Scope of Work.

  • Fearless Media will provide digital delivery of all final assets via an online gallery, download link, or designated platform.

  • Raw, unedited photo or video files are not included unless specified and agreed to in writing prior to project start.

6. Usage Rights & Licensing

  • Upon full payment, the client is granted complete ownership and unlimited usage rights to all final deliverables produced by Fearless Media for their own marketing, advertising, and promotional purposes across all platforms.

  • Fearless Media retains perpetual rights to use the same deliverables — including photos, videos, and creative assets — for its own portfolio, website, social media, advertising, and promotional purposes, unless otherwise agreed in writing.

  • Raw, unedited files remain the property of Fearless Media and are not included unless specifically stated in the project agreement.

7. Creative Control

  • Fearless Media maintains creative discretion in selecting visuals, music, editing style, and overall tone of the project unless otherwise specified.

  • Clients are encouraged to provide input during the planning phase; however, Fearless Media is not obligated to re-edit or alter creative direction after project completion beyond agreed revisions.

8. Client Responsibilities

  • The client agrees to provide accurate information, access, and materials needed for completion of the project.

  • The client is responsible for obtaining any necessary permissions, property releases, or participant consent for filming and photography at the project location.

  • The client must review and approve deliverables within 7 days of delivery. Failure to provide feedback within this period will be considered as approval.

9. Advertising & Social Media Management

  • Fearless Media will manage and optimize campaigns based on the agreed strategy and budget.

  • No guarantees are made regarding sales, performance, or specific results, as ad performance depends on multiple external factors beyond Fearless Media’s control.

  • The client is responsible for funding all ad spend directly through their advertising accounts unless otherwise arranged.

  • Fearless Media is not responsible for account restrictions, disapprovals, or third-party platform changes.

10. Website & Digital Projects

  • Fearless Media will build websites or landing pages according to approved mockups or plans.

  • The client is responsible for providing accurate content, copy, and imagery unless otherwise included in the package.

  • Hosting, domain, and ongoing maintenance are not included unless specifically stated.

  • Fearless Media is not liable for third-party hosting issues, downtime, or plugin conflicts after delivery.

11. Liability & Indemnification

  • Fearless Media is not responsible for incidental, indirect, or consequential damages, loss of revenue, or claims arising from the use of deliverables.

  • The client agrees to indemnify and hold harmless Fearless Media from any and all claims, damages, or expenses arising from the use or misuse of project materials.

12. Confidentiality

Fearless Media respects the confidentiality of client information and will not disclose project materials or proprietary details without consent. However, general visuals, behind-the-scenes content, or portfolio materials may be used for marketing purposes unless specifically prohibited in writing.

13. Force Majeure

Fearless Media is not liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to weather, natural disasters, equipment failure, illness, or acts of government.

14. Governing Law

These Terms and all agreements between the client and Fearless Media shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.

15. Acceptance

By booking, submitting payment, or signing an agreement with Fearless Media, the client acknowledges that they have read, understood, and agreed to these Terms, Conditions, and Disclaimers.
